AELORA LLC – TERMS OF USE

1. Agreement to These Terms

These Terms of Use (the “Terms”) form a binding agreement between you and Aelora LLC (“Aelora,” “Company,” “we,” “us,” or “our”) and govern your access to and use of the Aelora mobile application and related services (collectively, the “Service”).

By creating an account, or by accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not create an account and do not use the Service.

This agreement also serves as the End User License Agreement (EULA) for the Service.

2. Eligibility

You must be at least 14 years old, or the minimum age of digital consent in your jurisdiction, to use the Service. By using Aelora you represent that you meet this requirement and that you are able to form a binding contract. Membership is curated and may require approval or an access code.

3. Your Account

  • You agree to provide accurate, current, and complete information and to keep it up to date.
  • You are responsible for safeguarding your login credentials and for all activity under your account.
  • You may not impersonate any person or misrepresent your affiliation, identity, or creative work.
  • You may not maintain more than one account, or create a new account to evade a suspension or ban.

4. License to Use the Service

Subject to these Terms, Aelora grants you a limited, non-exclusive, non-transferable, revocable license to download and use the Service for your personal, non-commercial use. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Service except as permitted by law. All rights not expressly granted are reserved by Aelora.

5. Objectionable Content and Acceptable Use — Zero Tolerance

Aelora has zero tolerance for objectionable content and for abusive or harassing users. By using the Service you agree that you will not post, upload, share, send, or otherwise make available any content, and you will not engage in any conduct, that:

  • is unlawful, defamatory, fraudulent, or infringes anyone’s rights;
  • is hateful, discriminatory, or promotes violence or hatred against people based on race, ethnicity, national origin, religion, disability, gender, age, sexual orientation, or gender identity;
  • harasses, bullies, threatens, intimidates, stalks, or abuses any person;
  • is sexually explicit, pornographic, or sexually exploitative, or that sexualizes minors in any way;
  • depicts or encourages self-harm, graphic violence, or cruelty;
  • is spam, a scam, or a deceptive, misleading, or pyramid/solicitation scheme;
  • contains another person’s private or personal information without their consent; or
  • impersonates another person or entity.

You are solely responsible for the content you create and the way you interact with others. Content you submit does not reflect the views of Aelora.

Reporting and blocking

The Service provides tools to report objectionable content or behavior and to block any other user. We encourage you to use them. Reports are confidential to the person reported.

Our 24-hour commitment

We review reports of objectionable content and abusive behavior and act on them within 24 hours. Where a report is substantiated, we will remove the offending content and may suspend or permanently eject the user who provided it. Users may also be automatically suspended pending review when multiple members report them. We may take any of these actions at our sole discretion, with or without notice.

6. Your Content

You retain ownership of the content you create. By making content available through the Service, you grant Aelora a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content solely for the purpose of operating and improving the Service. You represent that you have the rights necessary to grant this license and that your content does not violate these Terms or any law.

7. Suspension and Termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if you violate these Terms, if your conduct may harm other users or Aelora, or as otherwise permitted by law. You may stop using the Service and delete your account at any time from within the app. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will continue to apply.

8. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Aelora does not guarantee that the Service will be uninterrupted, secure, or error-free, or that any user, content, or connection will meet your expectations. You interact with other users at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Aelora and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $50.

10. Indemnification

You agree to indemnify and hold harmless Aelora from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or the rights of any third party.

11. Apple App Store

If you download the Service from the Apple App Store, you acknowledge that these Terms are between you and Aelora only, not Apple, and that Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the Service. To the extent these Terms provide a license, that license is limited to use of the Service on Apple-branded products that you own or control and as permitted by the App Store Terms of Service. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Effective Date” above and, where appropriate, notify you in the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of South Africa, without regard to conflict-of-laws principles. Where required, you also retain the protections of mandatory consumer laws of your country of residence.
